What i am saying is that if we were proven to have known that he did this and would be suspended then Newcastle can sue us.

I honestly doubt it can be proved. It's jail time (or whatever punishment Italian law prescribes) for any person who knew about felony but didn't reported it to authorities, than charges for covering up crimes, intentional fraud and what not. Also they'll be removed from football for a while if not permanently.
If that case, Newcastle suing us would be least problem on plate of those who eventually knew about this.
So, even if board/management knew about it, I doubt they "discussed it" via phone or texts or email or any form of communication which can leave trace.

They have recorded phone call between Cardinale and Moncada where they're saying "let's sell this troubled kid to Newcastle before his gambling problems become public knowledge."? XY "protected witness" who will testify? that's just hearsay unless he have that phone call from above...
